Several aspects of Kagan’s nomination are notable. First, Elena Kagan is the first person to be nominated to the supreme court who has never been a judge since President Bush nominated Harriet Miers in 2005. When confirmed, Kagan will be the only justice on the court with no judicial experience. The last justices with no experience as a judge were Lewis Powell Jr. and William Rehnquist, joining the court in 1972.
